1. Introduction

These Terms and Conditions ("Terms") govern access to and use of the Viarcana website, including viarcanastudio.com and related Viarcana-controlled pages and services.

By accessing or using Viarcana, you agree to these Terms. If you do not agree with these Terms, you should not use the website.

These Terms govern your relationship with Viarcana regarding use of the website. They do not replace the terms governing purchases made through Fourthwall.

2. Role of Viarcana and Fourthwall

Viarcana presents original artworks and makes physical products featuring those artworks available for purchase through Fourthwall.

Fourthwall, not Viarcana, is the seller of the physical products purchased through the Fourthwall checkout.

Fourthwall acts as the Merchant of Record for qualifying product transactions and is responsible for the applicable sales transaction, including payment processing and other transaction-related activities according to Fourthwall's own terms.

Depending on the order, Fourthwall and its suppliers may also handle production, fulfillment, shipping, taxes, returns, refunds, replacements and other order-related operations.

Viarcana does not receive or store your full payment-card number or CVV.

When you proceed to the Fourthwall checkout, you may also be required to accept or otherwise be bound by Fourthwall's applicable customer terms, policies and privacy information.

Fourthwall's applicable customer terms and privacy information are made available during the relevant purchase process.

3. Eligibility

You may use Viarcana only if you have the legal capacity required under the law applicable to you.

If you are a minor or otherwise unable to enter into legally binding agreements, you must use the website only with the involvement and permission of a parent or legal guardian where required by law.

Viarcana does not knowingly invite children to make purchases independently where they are not legally able to do so.

4. Website Use

You may access and use Viarcana for lawful personal purposes, including browsing artworks and products, obtaining information and accessing the Fourthwall purchase process.

You must not:

• use Viarcana for unlawful, fraudulent or abusive purposes;
• attempt to gain unauthorized access to the website, infrastructure or administrative systems;
• interfere with or disrupt the website, servers, networks or security mechanisms;
• introduce malware, malicious scripts or harmful code;
• circumvent technical restrictions or access controls;
• impersonate another person or misrepresent your identity;
• use automated systems in a manner that places an unreasonable load on the website;
• scrape, reproduce or systematically extract Viarcana content for commercial use without permission;
• use Viarcana artworks to train, fine-tune or develop artificial-intelligence models without prior written permission;
• remove copyright, trademark or ownership notices;
• use Viarcana content in a manner that infringes intellectual-property rights.

5. Intellectual Property

Unless otherwise stated, the artworks, images, visual compositions, branding, website content, text, graphics, logos and other original material displayed on Viarcana are owned by, licensed to, or lawfully used by Andrea Crocco / Viarcana.

Such material may be protected by copyright, trademark and other intellectual property laws.

Purchasing a physical product does not transfer copyright, reproduction rights, commercial exploitation rights or any other intellectual property rights in the underlying artwork.

A customer purchasing a Viarcana product receives ownership of the physical item purchased, subject to applicable law, but does not acquire the right to reproduce, redistribute, resell copies of, license, modify for commercial purposes or otherwise commercially exploit the underlying artwork.

Personal display of a legitimately purchased physical artwork is permitted.

6. Image Protection

Viarcana may use technical measures intended to discourage unauthorized copying, downloading, dragging or reuse of artwork images.

These measures do not constitute digital-rights guarantees and may not prevent all forms of copying, screenshots or unauthorized reproduction.

The absence or circumvention of a technical restriction does not grant permission to reproduce or commercially use Viarcana content.

7. Product Information

Viarcana aims to present products, artwork previews, available sizes, materials and other product information as accurately as reasonably possible.

Product availability, variants, dimensions, production specifications and other commercial information may originate from Fourthwall or its production partners.

Images and mockups are intended to provide a realistic representation of the product, but they remain visual previews.

Minor differences may occur between digital previews and the physical product, including differences relating to:

• colour reproduction;
• display calibration;
• cropping;
• print positioning;
• material texture;
• canvas depth or framing;
• production tolerances;
• lighting conditions.

Nothing in this section limits mandatory consumer rights relating to defective, incorrect or non-conforming goods.

8. Prices

Product prices displayed through Viarcana are intended to reflect the current price associated with the relevant Fourthwall product or variant.

The final price payable by the customer is the price shown and confirmed through the applicable Fourthwall checkout.

Depending on destination and applicable law, the final amount may include or be affected by:

• shipping charges;
• VAT or sales taxes;
• duties or import charges;
• currency conversion;
• other charges displayed during checkout.

If a price shown on Viarcana differs from the final price shown by Fourthwall before payment, the Fourthwall checkout price governs the purchase transaction unless mandatory law provides otherwise.

9. Orders and Checkout

Selecting a product on Viarcana may create or prepare a Fourthwall shopping cart.

The purchase is completed through a checkout operated by Fourthwall, even where the checkout is presented using a Viarcana-branded domain or subdomain.

A product purchase contract is concluded with Fourthwall, not with Viarcana.

Fourthwall may accept or reject an order according to its applicable terms, availability checks, payment verification, fraud prevention procedures and legal obligations.

You are responsible for providing accurate and complete information during checkout, including contact and delivery information.

10. Payment

Payments for physical products are processed through Fourthwall and its payment service providers.

Available payment methods may vary according to your country, currency, device and the payment methods supported by Fourthwall at the time of checkout.

Viarcana does not independently process or store full payment-card credentials.

Any payment authorization, capture, refund or payment dispute relating to the product transaction is handled according to the applicable Fourthwall and payment provider terms.

11. Production and Fulfillment

Products purchased through the Fourthwall checkout may be produced on demand.

Production and fulfillment may be performed by Fourthwall or by third-party production partners selected or managed by Fourthwall.

Production times may vary depending on product type, variant, production location, order volume and other operational circumstances.

12. Shipping and Delivery

Shipping options, estimated delivery times and applicable shipping costs are determined through the Fourthwall purchase process.

Delivery estimates are estimates and may be affected by circumstances such as:

• production times;
• carrier delays;
• customs processing;
• weather;
• holidays;
• incorrect or incomplete delivery information;
• events outside the reasonable control of Viarcana or Fourthwall.

Any applicable shipping restrictions and available delivery methods should be displayed during checkout.

13. Customs, Duties and Import Charges

International orders may be subject to customs duties, import taxes, handling fees or other charges imposed by the destination country.

Where such charges are not collected during checkout, they may become payable by the recipient upon import or delivery.

The treatment of duties and taxes applicable to a particular order is determined by Fourthwall, the relevant carrier and applicable law.

14. Cancellations, Returns, Refunds and Exchanges

Returns, refunds, cancellations, exchanges and replacement requests relating to physical products are governed by Fourthwall's applicable policies and mandatory consumer law.

Viarcana does not impose a separate return or refund policy that overrides, restricts or conflicts with Fourthwall's policies or mandatory consumer rights.

Many products may be produced on demand. The availability of cancellation, return or exchange rights for non-defective products may therefore depend on the nature of the product, the applicable Fourthwall policy and mandatory law in the customer's jurisdiction.

Nothing in these Terms excludes rights that consumers are legally entitled to exercise in relation to defective, damaged, incorrect or otherwise non-conforming products.

15. European Union and EEA Consumer Rights

If you are a consumer in the European Union or European Economic Area, you may benefit from mandatory consumer-protection rights under EU and national law.

Depending on the nature of the transaction and product, these may include rights relating to:

• pre-contractual information;
• transparent pricing;
• delivery;
• legal conformity of goods;
• remedies for defective or non-conforming products;
• withdrawal from eligible distance contracts.

The standard EU withdrawal period for eligible distance contracts is generally 14 days, subject to statutory exceptions.

The Fourthwall checkout and applicable Fourthwall terms should identify the cancellation or withdrawal rights applicable to the particular transaction.

Consumers located in the United Kingdom may benefit from mandatory rights under UK consumer law.

Nothing in these Terms is intended to limit rights that cannot lawfully be excluded or restricted.

17. Consumers in Other Countries

Customers located outside the European Union and United Kingdom may have additional mandatory consumer rights under the laws applicable in their jurisdiction.

These Terms do not exclude rights that cannot legally be waived.

18. Damaged, Defective or Incorrect Products

If a product arrives damaged, defective, incorrect or with an apparent production problem, contact customer support as soon as reasonably possible.

You may be asked to provide:

• the order reference;
• a description of the issue;
• clear photographs showing the problem;
• other information reasonably necessary to investigate the issue.

Information submitted to Viarcana may be shared with Fourthwall where necessary to resolve the order issue.

19. Order Communications

Fourthwall may send transactional communications relating to purchases for which it acts as seller or Merchant of Record.

Viarcana may separately send branded transactional communications relating to the same order, such as confirmation, status or customer-support messages.

Viarcana transactional messages do not replace official transaction documentation or communications that Fourthwall is required to provide as seller or Merchant of Record.

20. Customer Support

Viarcana provides customer-support assistance relating to use of the website and may assist customers in communicating about Fourthwall orders.

Certain order actions, including refunds, cancellations or replacements, may need to be processed by Fourthwall.

21. Third-Party Services

Viarcana relies on third-party services including Fourthwall, Cloudflare, Amazon Web Services and Google.

The website may also contain links or redirects to third-party websites or services.

When you interact directly with a third-party service, its own terms and privacy policies may apply.

Viarcana is not responsible for independent third-party websites or services except to the extent liability cannot be excluded under applicable law.

22. Website Availability

Viarcana aims to keep the website available and functioning correctly but does not guarantee uninterrupted or error-free availability.

The website may temporarily become unavailable for maintenance, updates, technical problems, infrastructure incidents or circumstances outside Viarcana's reasonable control.

23. Errors and Corrections

Despite reasonable efforts, the website may occasionally contain typographical errors, inaccurate information, outdated availability data or technical errors.

Viarcana may correct website information at any time.

Where an error relates to a Fourthwall purchase, the actual transaction remains subject to the information confirmed through Fourthwall and to mandatory consumer law.

Content displayed on Viarcana is provided for artistic, informational and commercial presentation purposes.

Nothing on the website constitutes legal, financial, medical, technical or other regulated professional advice.

25. Limitation of Liability

To the maximum extent permitted by applicable law, Viarcana is not liable for indirect, incidental or consequential losses resulting solely from use of or inability to use the website.

Viarcana is not responsible for failures caused exclusively by independent third-party services, carriers or events outside its reasonable control, except where applicable law provides otherwise.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms limits mandatory consumer rights or liability that cannot legally be excluded.

26. Force Majeure

To the extent permitted by law, Viarcana will not be responsible for delays or failures caused by events outside its reasonable control, including major network outages, natural disasters, war, civil disturbance, government action, carrier disruption, widespread infrastructure failure or similar extraordinary events.

This provision does not limit mandatory consumer rights.

27. Suspension or Restriction of Access

Viarcana may restrict or block access to the website where reasonably necessary to:

• protect the website or its users;
• respond to security threats;
• prevent fraud or abuse;
• comply with legal obligations;
• address serious violations of these Terms.

Such measures will be proportionate to the circumstances where reasonably possible.

28. Privacy

Personal data is processed according to Viarcana's Privacy Policy.

Optional analytics technologies are managed according to the user's cookie preferences where applicable.

29. Changes to the Website

Viarcana may modify, improve, replace or discontinue website features from time to time.

This may include changes to artworks, product presentation, supported product types, prices displayed from Fourthwall, integrations or other website functionality.

30. Changes to These Terms

Viarcana may update these Terms where necessary because of changes in law, website functionality, business operations, third-party providers or other legitimate reasons.

The date shown at the beginning of these Terms indicates the latest revision.

Material changes will be communicated where required by applicable law.

Changes will not retroactively remove mandatory rights relating to transactions already concluded.

31. Governing Law

These Terms relating to use of the Viarcana website are governed by Italian law, subject to any mandatory consumer-protection rules that apply under the law of the country in which the consumer resides.

Nothing in this section deprives a consumer residing in the European Union, European Economic Area, United Kingdom or another jurisdiction of mandatory protections provided by applicable law.

Product purchase contracts concluded with Fourthwall may be governed by the applicable Fourthwall customer terms.

32. Disputes

For consumers, any competent court or dispute-resolution right provided by mandatory consumer law remains available.

Nothing in these Terms requires a consumer to waive a jurisdiction or remedy that cannot legally be waived.

Disputes concerning the sale, payment, refund or fulfillment of a Fourthwall product may also be subject to Fourthwall's applicable customer terms and support procedures.

33. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary and the remaining provisions will continue to apply, to the extent permitted by law.

34. No Waiver

Failure by Viarcana to enforce a provision of these Terms does not constitute a permanent waiver of that provision or any other right.

35. Entire Agreement for Website Use

These Terms, together with Viarcana's Privacy Policy and other policies expressly referenced here, constitute the terms governing use of the Viarcana website.

They do not replace or override the separate contractual terms applicable between Fourthwall and customers purchasing products through the Fourthwall checkout.
